These terms and conditions (the “Terms and Conditions”) govern your use of the website https://okmedical.com.mt/ (the “Site”), owned and operated by OK Medical Ltd. The Site serves as an e-commerce platform.

By accessing or using this Site, you confirm that you have read, understood, and agreed to comply with these Terms and Conditions at all times.

In these Terms, “OK Medical,” “we,” “us,” or “our” refers to OK Medical Ltd.

These Terms (the “Terms” or the “Contract”) govern your use of the Store and the purchase of products from the Store, forming a binding agreement between you and OK Medical.

By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, you should discontinue use of the Site and refrain from purchasing from the Store.

For consumers (purchases made outside the course of trade or business), specific withdrawal rights apply, as detailed in Section 8.

This Contract is concluded electronically and is available in English only.

We may modify these Terms from time to time, and you are responsible for reviewing them periodically. The Terms applicable at the time of your purchase or use of the Site will govern your transaction.

3.1 By using the Site or placing an order, you agree to:

  • Use the Site for lawful purposes and place valid orders only.
  • Be at least 18 years old and legally capable of entering into contracts.
  • Avoid placing fraudulent or false orders. If fraud is suspected, we reserve the right to cancel the order and notify relevant authorities.
  • Refrain from using the Site or its products for unlawful purposes, including copyright infringement.
  • Avoid transmitting malware, viruses, or destructive code.
  • Provide accurate and truthful contact and delivery details.

3.3 Breaching these Terms, particularly your obligations under this section, may result in immediate termination of the Contract.

4. Products

4.1 The Store offers medical consumables, devices, and other products, which may vary over time. Sale items and promotional activities are subject to change at the discretion of OK Medical.

4.2 Product descriptions, such as size, color, and pricing, are provided before purchase. However, images, specifications, and other advertising materials are for illustrative purposes only and may not perfectly represent the actual product.

5. Prices and Payment

5.1 Product prices are displayed in Euros (EUR) and are valid at the time of order placement. Prices are subject to change but will not affect orders already placed.

5.2 Payment must be made in full, including VAT and delivery fees, prior to delivery.

5.3 Upon completing your order, you will receive a confirmation email containing order details and confirmation of the Contract.

5.4 In the event of pricing errors, we will notify you and offer the option to proceed at the correct price or cancel the order. If we cannot reach you, the order will be canceled, and any payment refunded.

5.5 Payments can be made via credit card, and your account will be charged upon order confirmation.

6. Shipping and Delivery

6.1 Goods will be delivered via the following methods:

  • Standard Delivery: 1–5 business days (excluding weekends and holidays).

6.2 Delivery charges:

  • Orders below €60 will incur a €10 delivery fee.
  • Free delivery is available for heavy equipment delivered to the ground floor. Delivery to higher floors requiring a lifter will incur an additional charge.

6.3 You must provide accurate delivery details. We are not responsible for failed deliveries due to inaccurate or incomplete information provided by you.

7. Refunds

We do not issue cash refunds. Instead, we offer credit vouchers for returned products within 14 days of receipt.

Exchanges are accepted for the following reasons:

  • Unused and unwanted goods.
  • Damaged or defective goods.
  • Goods not matching the description.
  • Incorrect sizing.

Exclusions: Returns or exchanges are not accepted for toiletry equipment due to hygiene reasons.

8. Returns

Returns can be made in person at the following location:

  • OK Medical, Swatar, Birkirkara.

9. Transfer of Risk

Ownership of products transfers to you upon full payment. Risk of loss or damage passes to you upon physical possession of the products.

You agree to indemnify and hold harmless OK Medical and its affiliates, employees, and agents from any claims or damages arising from your breach of these Terms or violation of any law or third-party rights.

11. Severability

If any provision of these Terms is deemed unlawful or unenforceable, it will be severed from the Terms without affecting the validity of the remaining provisions.

12. Term and Termination

The Contract begins when your order is confirmed and terminates upon product delivery. However, obligations arising before termination, such as payment, survive termination.

You may terminate these Terms by notifying us. We may terminate the Contract immediately for violations of these Terms.

13. Entire Agreement

These Terms, along with any posted policies, constitute the entire agreement between you and OK Medical, superseding prior agreements or communications.

14. Governing Law and Dispute Resolution

14.1 These Terms are governed by Maltese law.

The Maltese Courts have jurisdiction over disputes arising from this Contract.
